EU General Court: European Commission Illegally OK'd GM Potato Crop for Cultivation

The European Union's second highest court ruled the European Commission broke EU law when it approved in 2010 a genetically modified potato crop, which became only the second GM plant to get a green light for cultivation in the 28 EU member states. The General Court of the European Union, which arbitrates commercial disputes, ruled that the commission was obligated under EU regulatory procedures to inform EU member states of dissenting opinions in the second of two scientific opinions from the European Food and Safety Authority that concluded the GM crop posed no danger to human health or the environment. “If the commission has complied with those rules, the result of the procedure or the content of the contested decisions could have been substantially different,” the EU court said in a statement. The ruling (T-240/10) stems from a legal challenge launched by Hungary to the 2010 commission decision. Supporting Hungary in the case were France, Austria, Poland and Luxembourg.
