OCEAN Spray Cranberries Inc has used patent litigation as a tool to corner the lucrative market for sweetened dried cranberries for its popular Craisins, rival Decas Cranberry Products Inc alleges. Ocean Spray hit Decas with a patent suit to scare away prospective buyers of the independently held cranberry products maker, Decas said in counterclaims filed on 23 June. Jeff Carlson, Decas's chief executive, said: "The timing of Ocean Spray's patent infringement lawsuit is highly suspect, as it was made at a time when Decas was seeking outside investment to fuel future innovation and growth and numerous cranberry growers were exploring the possibility of signing on with Decas."
